1. About these Terms
These Terms & Conditions ("Terms") govern your access to our website and your purchase of smart watches and related accessories ("Products") from Sandesha Sales Corporation, a partnership firm registered in India (GSTIN 27ACWFS4426N1Z7) with its principal place of business at S-19, S K Open Mall, College Road, Nashik, Maharashtra - 422005, India ("Sandesha", "we", "us", "our"). By browsing the website, placing an order or registering as a distributor you agree to these Terms, our Privacy Policy, Return, Refund & Cancellation Policy, Shipping Policy and Warranty Policy.
If you do not agree, please do not use the website. We may update these Terms from time to time; the version published on the website on the date of your order applies to that order.
2. Eligibility
You must be at least 18 years old and capable of entering into a legally binding contract under the Indian Contract Act, 1872 to place an order or become a distributor. Minors may use Products only under the supervision of a parent or guardian, who is responsible for the purchase.
3. Products & Information
We try to describe and photograph Products accurately. Illustrations on the website are representative; actual colour, strap finish and watch faces may differ slightly. Battery life, charging time and other performance figures are typical values measured under controlled conditions and vary with usage, settings and environment.
Smart watches sold by us are consumer wellness and fitness devices. Heart-rate, SpO2, sleep, stress and similar readings are indicative only and are not medical devices or a substitute for professional medical advice (see Disclaimer).
4. Pricing & Taxes
- All prices are in Indian Rupees (INR) and are inclusive of GST unless stated otherwise.
- "MRP" is the maximum retail price printed on the Product or its packaging; the selling price shown is the price you pay.
- Shipping charges, if any, and the Cash on Delivery handling fee (where selected) are confirmed with your order before you confirm the order.
- We may change prices, offers and availability without notice. A price change will not affect an order we have already confirmed.
- If a price is displayed incorrectly due to a typographical or technical error, we may cancel the order and refund any amount received in full.
5. Placing & Accepting Orders
Submitting an order is an offer to purchase. A contract is formed only when we confirm the order by WhatsApp, phone, SMS or email, or dispatch the Product. We may decline or cancel an order for reasons including stock unavailability, suspected fraud, an undeliverable pin code, pricing error or failure to verify your details, in which case any payment received is refunded in full.
You agree to provide accurate and complete name, mobile number and delivery address. We are not responsible for delay or non-delivery caused by incorrect details.
6. Payment
We accept the following modes, as confirmed when we accept your order: Cash on Delivery (where available for your pin code) and UPI / bank transfer after order confirmation. We will never ask for your card number, CVV, UPI PIN or OTP over WhatsApp, phone or email — do not share these with anyone claiming to be us. Pay only to the bank account or UPI ID confirmed on our official WhatsApp number or on a payment link we send.
7. Delivery, Returns & Warranty
Delivery timelines are governed by our Shipping Policy. Returns, replacements, refunds and cancellations are governed by our Return, Refund & Cancellation Policy. Manufacturing defects are covered by our Warranty Policy.
8. Independent Distributors
Persons who register to sell Products as independent direct sellers are bound additionally by our Direct Seller Policy. A distributor is an independent contractor, not an employee, agent, partner or franchisee of Sandesha. Earnings are not guaranteed; any illustration of income on this website is indicative only.
9. Intellectual Property
The SANDESHA name, logo, website design, text, graphics and product descriptions are owned by or licensed to us and protected by Indian law. Our “S” emblem is a registered trademark (Trade Mark No. 3599052, Class 35) under the Trade Marks Act, 1999. You may not copy, modify, reproduce, scrape or commercially exploit any part of the website without our written permission. Third-party brand names, if any, belong to their respective owners.
10. Acceptable Use
You agree not to: (a) use the website for any unlawful purpose; (b) attempt to gain unauthorised access to our systems; (c) introduce malware or interfere with the website's operation; (d) submit false or misleading information; (e) place orders for resale outside the distributor programme using false identities; or (f) misuse promotional offers.
11. Limitation of Liability
To the fullest extent permitted by law, our total liability arising out of any order is limited to the price actually paid by you for the Product concerned. We are not liable for indirect, incidental or consequential loss, loss of data or profit, or for delays or failures caused by events beyond our reasonable control (force majeure), including natural calamity, strikes, courier or network failure, or government action. Nothing in these Terms excludes liability that cannot be excluded under the Consumer Protection Act, 2019.
12. Governing Law & Disputes
These Terms are governed by the laws of India. Please first write to our Grievance Officer so that we can try to resolve your concern amicably. Subject to your statutory rights as a consumer to approach the appropriate Consumer Commission, the courts at Nashik, Maharashtra shall have exclusive jurisdiction.
